Patanova – Terms & Conditions of Booking

1. AGREEMENT TO TERMS

By booking a tour, expedition, or activity with Patanova Outdoor Inc (Patanova) ("Company," "we," "us," or "our"), you ("Participant," "you," or "your") agree to these Terms & Conditions. This legally binding agreement outlines policies regarding payment, cancellations, risks, responsibilities, and liabilities. If you do not agree, do not book or participate in our tours.

2. DEFINITION OF TERMS

Owner(s):
Refers to the individual(s) or entity responsible for the management, operation, and oversight of Patanova Outdoors Inc (Patanova), including but not limited to the decision-making processes, supervision of tours, and implementation of these Terms & Conditions. The "Owner(s)" may also refer to authorized representatives or agents acting on behalf of Patanova Outdoors Inc (Patanova).

Host:
An individual or entity, appointed by the Owner(s), responsible for guiding, organizing, and overseeing specific activities or tours offered by Patanova Outdoors Inc (Patanova). The "Host" may include tour guides, trip coordinators, or other personnel directly involved in the day-to-day operations of the tour or activity, ensuring safety, adherence to the itinerary, and providing support to the Participants.

Guest (Participant):
Any individual who books, attends, or participates in a tour, activity, or expedition offered by Patanova Outdoors Inc (Patanova). The term "Guest" or "Participant" applies to anyone who enters into an agreement with Patanova Outdoors Inc (Patanova) for participation in any scheduled or unscheduled activities and who agrees to these Terms & Conditions.

Staff:
Any individuals employed by or working under the direction of Patanova Outdoors Inc (Patanova) to assist in the operations of the tours, including but not limited to tour guides, coordinators, drivers, cooks, and medical personnel. Staff members are responsible for ensuring the proper functioning and safety of the activities but are not responsible for activities occurring during unscheduled/free time.

3. BOOKING & PAYMENT

  • A deposit or full payment is required at booking, as specified per tour.
  • All balances must be paid in full by the deadline before departure; failure may result in cancellation without refund.
  • “Departure” or in any other terms “the start of a trip” is defined as 12 AM EST the day of the beginning of the trip and/or the first planned item on the itinerary.
  • Prices may change until full payment is received and confirmed in writing.
    • “Price will not increase by more than 20% percent of original agreed upon trip cost declared when initial deposit was placed”
    • “Attendee agrees that any price change for any reason within 20% of initial total trip cost will not be valid grounds for any refunds and will not constitute a deviation from agreed upon contractual terms”
    • Written requests or communications will be timed based on calendar day and timestamp. 12 AM EST will be used to mark a change in day and 7 elapsed days to mark 1 week.
    • ‘If total trip cost increase exceeds 20% of original total trip cost amount defined when initial deposit was made the attendee has the right to a refund of all payments and deposits made if a written request is made within 1 week of notification of said increase and not within 2 weeks of the start of the trip
    • “If the cost of the trip is increased by greater than 20% of initial deposit within 2 weeks of the start of the trip the attendee will be entitled to a full refund if a written request is made within 1 week and prior to 24 hours before the start of the trip.”
    • A price increase of greater than 20% over the original stated and agreed upon total trip cost will trigger the above refund terms that supersede refund terms and conditions of section 3 “Cancellation and Refund Policy” of the contract below.
  • Payments are final; disputes regarding charges must be submitted in writing within seven (7) days of payment.

4. CANCELLATION & REFUND POLICY

Cancellations by Participant:

  • More than 60 days before departure: Refund minus the non-refundable deposit and processing fee.
  • 30-59 days before departure: 50% refund minus deposit.
  • Less than 30 days before departure: No refunds.
  • No refunds for no-shows, early departures, or unused tour portions.

Cancellations by Patanova Outdoors Inc (Patanova):

  • If canceled due to force majeure (natural disasters, pandemics, war, civil unrest, travel restrictions, government actions, etc.), you will be offered a full refund.

5. TRAVEL REQUIREMENTS & RESPONSIBILITIES

  • You must ensure you have all necessary travel documents (passports, visas, permits, vaccinations, etc.).
    • Participants are responsible for reading and understanding the information primer provided and ensuring that all steps are followed. Tour leadership will be considered a supplement to an individual participants knowledge of, acceptance of, and adherence to these guidelines, laws, and regulations. Failure to ensure possession of all necessary documentation and resources will not be grounds for any refund of any kind once the trip has begun.
  • You must comply with local laws and regulations.
    • Participants are responsible for reading and understanding the information primer provided and ensuring that all steps are followed. Tour leadership will be considered a supplement to an individual participants knowledge of, acceptance of, and adherence to these guidelines, laws, and regulations. Failure to ensure possession of all necessary documentation and resources will not be grounds for any refund of any kind once the trip has begun. Participants are solely responsible for knowing and following all local laws and customs.
  • You affirm you are in good health and fit for participation. Some activities may require medical clearance or waivers.
  • We may deny participation to anyone deemed unfit or unsafe, without refund.

6. SCHEDULED ACTIVITIES & UNSCHEDCULED ACTIVITES/FREE TIME

The parties acknowledge that any activities or events outlined in this agreement are categorized as either scheduled or unscheduled/free time.

·  Scheduled Activities: These are activities, events, or duties that are prearranged, with set dates, times, and locations, and are explicitly directed or organized by the Owner(s) (whatever terms we want to consistently add in terms of staff and affiliates) of the company. The individual agrees to participate in these activities as required, subject to reasonable notice from the Owner(s).

·  Unscheduled/Free Time: Any time not specifically designated as a scheduled activity is considered free or unscheduled time, during which the individual is free to engage in personal activities at their own discretion, including but not limited to socializing, leisure, drinking, or participating in any form of recreation or entertainment.

·  Liability Disclaimer for Unscheduled/Free Time Activities: The Owner(s) of the company shall not be held liable for any activities, actions, incidents, injuries, or damages that occur during the individual's unscheduled or free time, including but not limited to those arising from the consumption of alcohol, participation in parties, or any other recreational activities. The individual acknowledges that during free time, they are solely responsible for their own actions and well-being, and that the Owner(s) are not liable for any consequences resulting from such activities.

·  Acknowledgment of Risk: The individual understands and agrees that participation in any unscheduled activities, including those involving alcohol, partying, or other potentially hazardous behavior, is at their own risk, and the Owner(s) of the company are not responsible for any injuries, accidents, or legal matters arising from such activities.

7. RISKS, LIABILITY & INDEMNIFICATION

  • Acknowledgment of Risk: Adventure travel carries inherent risks, including injury, illness, property damage, environmental hazards, death, and acts of third parties.
  • Assumption of Risk: You voluntarily assume all risks associated with participation and waive any claims against Patanova Outdoors Inc (Patanova), its owners, employees, agents, contractors, and affiliates.
  • Limitation of Liability: Patanova Outdoors Inc (Patanova) is not liable for any injury, death, loss, damage, or expenses caused by delays, cancellations, force majeure, accidents, third parties, theft, or unforeseen circumstances. Our liability is limited to the total amount paid for the ticket.
  • Indemnification: You agree to indemnify and hold harmless Patanova Outdoors Inc (Patanova), its employees, and agents from any claims, liabilities, or damages arising from your participation.

8. CONDUCT & SAFETY

  • Participants must follow all guide instructions.
  • Disruptive, illegal, or dangerous behavior may result in immediate removal from the tour without refund.
  • Participants are responsible for damages caused to property, equipment, or third parties.
  • Patanova Outdoors Inc (Patanova) reserves the right to refuse service or terminate participation at its discretion.

9. EQUIPMENT & GEAR

  • Participants must bring necessary personal gear as outlined in the packing list.
  • Any provided equipment must be returned in its original condition. Participants will be responsible for damages, loss, or theft of provided gear.

10. TRANSPORTATION

  • Transportation within the destination country is included in the trip package.
  • Participants are responsible for arranging and covering their own travel to the destination country unless otherwise stated by Patanova Outdoors Inc (Patanova).
  • Complimentary travel planning assistance is included in the ticket price to help participants coordinate their travel arrangements.

11. TRAVEL INSURANCE

  • Travel insurance covering medical expenses, trip cancellations, and emergency evacuations is included in the ticket price.
  • Details of coverage will be provided before departure.

12. MEDIA RELEASE

  • By participating, you grant Patanova Outdoors Inc (Patanova) the right to use photos, videos, or other media taken during the tour for promotional purposes.
  • If you do not consent, you must notify us in writing before the tour.

13. FORCE MAJEURE

  • Patanova Outdoors Inc (Patanova) is not responsible for cancellations, delays, or changes caused by uncontrollable events (natural disasters, government actions, strikes, pandemics, etc.).
  • Efforts will be made to reschedule affected tours, but no cash refunds will be issued. Any credit or rescheduled tour must be used within 12 months from the original departure date, unless otherwise specified.

14. DISPUTE RESOLUTION & GOVERNING LAW

  • These Terms & Conditions are governed by the laws of the jurisdiction where Patanova Outdoors Inc (Patanova) is registered.
  • Disputes must first be resolved through mediation; if unsuccessful, binding arbitration will follow.
  • Participants waive their right to lawsuits or class-action claims against Patanova Outdoors Inc (Patanova), to the fullest extent permitted by applicable law. Some jurisdictions may not allow the limitation of certain rights, and in such cases, this waiver may not apply to you.

15. MODIFICATIONS TO TERMS

  • Patanova Outdoors Inc (Patanova) reserves the right to update these Terms & Conditions at any time. Changes take effect upon website posting or direct notification to participants.
    • If terms are changed after a deposit has been made by a participant but two weeks or more before the start of a trip a request for a refund may be made in writing. This does not mean the request will be honored and the participant requesting a refund will need to make a compelling argument for impact to the participant based directly on the changed contractual terms. These determinations will be made on a case-by-case basis with the individual participants and the final decisions will be made by the Owners.
    • If terms are changed during a trip (at any time after “departure” or “the start of the trip” and before the completion of the final itinerary item) no refunds will be eligible but individual concerns related specifically to changed terms will be discussed by the Owners and any remediation will be considered on a case-by-case basis.
